Guidelines for submitting content

These Guidelines outline what we consider is acceptable and unacceptable content. We may update the Guidelines from time to time, so please read them each time you submit content.

General

1: Celebrating the trench coat

The purpose of the Art of the Trench site (the "Site") is to celebrate the Burberry trench coat. We welcome your submissions (photographs, profile and comments) and want you to be involved. Don't forget that this is a public forum and that you are legally responsible for what you submit.

2: No advertising, solicitation or investigations

You must not use the site for:

  • any commercial purpose (including to promote your products or services), without our express permission.
  • any sponsorship, petition, campaign, scheme, investigation or chain message.

3: Report inappropriate content to us

Please help us in maintaining high standards of participation. If you consider that any content does not comply with these Guidelines or our Terms, please contact us immediately. If you think a comment is inappropriate, please use the Report facility, located to the right of the comment in issue. If the facility is not available, please email us at artofthetrench@burberry.com.

Comments and profiles

4: Language and relevance

We are looking for comments about clothes, style and fashion. Please ensure your comment is relevant and will not be misunderstood. Please be polite and don't use crude language. You can express a strong opinion, but don't go over the top. Many different types of people of different ages may view the Site.

Do not insult other contributions or discuss the non-appearance or removal of any content. If you would like to discuss the operation of the Site with us, please email us on artofthetrench@burberry.com.

5: No libel or other abuse

You must not make or encourage comments which are:

  • defamatory, false or misleading
  • insulting, threatening or abusive
  • obscene or of a sexual nature
  • offensive, racist, sexist, homophobic or discriminatory against any religions or other groups

6: Confidentiality, privacy and contempt

Please respect people's privacy. You are not allowed to submit confidential or private information. For example, you must not upload the telephone number, email or physical address or any other contact details of any person or discuss their private life. Remember that you will have no control over information that you post once it is available on the Web; please consider this before you post.

7: No impersonation and proper disclosure

You must not pretend to be someone else (e.g. another user or a member of our team). You must not pretend that you are unconnected to a person or other matter, when in fact you are. If you have a personal connection to something on the Site, you should disclose your connection or, where appropriate, not comment at all.

8: No linking or copyright infringement

You must not insert links to websites (URLs) or submit content which would be an infringement of copyright.

Photographs

9: Submitting trench photographs

To submit a photograph to us, you must satisfy all the requirements on the Submit Your Trench page, provide us with all the correct information and comply with our Terms and these Guidelines. We will use our absolute discretion when selecting photographs for inclusion on the Site. Please do not email us asking why your photograph has not been selected. You should expect only a very few photographs are likely to be selected. We hope you will not be disappointed if your photograph does not make it.

Copyright

If you wish to submit a photograph to us, you must have taken the picture yourself and own the copyright in the photograph. You must not send us photographs that you have copied from somewhere else.

Consent

Before you send us any photographs, please make sure that the person in the picture is happy to appear on the Site. You should obtain the person's consent to being photographed and appearing on the Site.

Please send them a link to this Site (www.artofthetrench.com) and these Guidelines. Remember also to make it clear to them that the public can submit comments about the photographs and click on the 'Like' or 'Share' buttons.

We may need to contact you so you need to send us your contact details.

Quality of photographs

Please only submit high quality photographs. Any grainy or blurred photos are unlikely to be selected.

Style of photographs

We are looking for images of people wearing Burberry trench coats. We may edit photographs (e.g. to crop or blur out other people or brands).

10: Submitting Profile photographs

A profile photograph must be a picture of you. You must only upload a profile photograph if you are the copyright owner or have permission from the copyright owner to use the photograph for your profile. We will not review profile photographs.

11: Removal of content

User content that violates the letter or spirit of these Guidelines or our Terms may be removed (or, if reviewed in advance, not published in the first place). If we remove something, we will generally remove the whole thing. This means that even if only one sentence is objectionable, the whole comment will usually be removed (or not published). Similarly, we may also remove a whole thread or profile, even if only one aspect is inappropriate.

If a comment or a thread is removed, this may be for any number of reasons. Usually, this will be because the comment breaks these rules or our Terms or is the subject of an abuse report. Sometimes, the comment may be removed because it is connected to another comment which is being removed. We hope that you will understand that, once properly notified of a complaint, we may have to remove a comment for legal reasons (whatever the rights and wrongs).

If your content has been removed, we may email you to let you know or to inform you if you have been suspended or banned from submitting further comments to the Site.

If you are aware that content has been removed, you must not deliberately resubmit the same content.

12: Suspension and termination

We reserve the right to suspend or ban an account at our sole discretion. Here are some reasons why we might do so:

  • Breaching these rules or our Terms
  • Serious failure to respect the spirit and tone of the community
  • Conduct or comments that demand a disproportionate amount of our time or that abuse our staff

The length of a suspension or whether we ban someone depends on all the circumstances. Bans are generally for extreme cases and repeated serious abuse.

If we suspend or ban your registration, you must not attempt to re-register or submit content (e.g. using someone else's account), without our permission.

Personal information we may collect from you

You can access the Site without registering, but you have to register via Facebook in order to submit comments or photographs to the Site. We will ask for your name, email address, country of residence, and other details as set out in the online registration form and when you submit photographs, reply to surveys, or enter promotions. Most of this information may be entered at your discretion. However, if you withhold requested information, we may not be able to provide you with certain services.

You may provide us with additional personal information, including personal information related to other people, in the course of using the Site, for instance photographs of other people wearing trenchcoats, their name, the date and location of the photograph and other information. You must get their consent as set out in our Guidelines before submitting photographs of them to the Site.

When you connect via Facebook, a photograph of you, the name of the city or area where you live, a link to your Facebook homepage will form part of your profile page. Together with the photographs you mark as your favourites and any comments you make via the Site, this information about you will be public and visible by all users (whether registered with the Site or not). You can edit the 'About me' section on your Profile and you can choose to have your profile page deleted by disconnecting to the Art of the Trench via Facebook, but please note the photographs and comments you submit to the Site will remain on the Site indefinitely even if you decide to stop being a user.

Any information disclosed in your profile or in comments and photographs you submit become public information and you should always be careful in deciding whether to disclose personal information.

If you submit another person’s details to us for the purpose of sharing information or content with them, you should make sure they are happy for you to send their details and to use receiving them. We will only use the information submitted in this way for the purpose of the share facility.

Will you disclose any of my personal data to third parties?

Group companies: We may disclose your personal information to other companies in the Burberry group and joint ventures and franchisees which operate under the Burberry namefor the purposes set out in this policy.

Third party service providers: Under protection of confidentiality agreements, we use third parties to provide services and manage our sites and relationships with you. These may include website hosting and organisation that assist us in our direct marketing activities. Third-party processors and providers will be given access only to that information needed to perform their support functions, and are prohibited from using it for other purposes.

Direct marketing: See below, under ‘Burberry communications’ for further information.

Reorganisation: In the event that we or a part of our business undergo re-organisation or are sold to a third party, you agree that any personal information we hold about you may be transferred to that re-organised entity or third party.

Legal issues: We may disclose, but are not obliged to disclose, your personal information if required to do so by law or order of the court or if we believe that such action is necessary to prevent fraud or cyber crime or for the purpose of, or in connection with, any legal proceedings (including prospective legal proceedings) or for the purposes of obtaining legal advice or to protect us, our affiliates, our Site or the rights (including the rights of privacy, confidentiality and reputation), property or personal safety of any person or otherwise in accordance with the Data Protection Act 1998.
